Horizon 2 Stunt Performer Sues Kevin Costner Over Unscripted Rape Scene

Kevin Costner has responded to a lawsuit from stunt performer Devyn LaBella over an alleged unscripted rape scene in Horizon: An American Saga Chapter 2. The claims have drawn widespread attention, prompting Costner’s legal team to deny the allegations and defend his actions on set.

LaBella claimed that Costner, who directed the film, asked her to perform a violent scene without warning, consent, or an intimacy coordinator, which violated union protocols. LaBella worked as the stunt double for actress Ella Hunt. According to the lawsuit, Hunt refused to act in a rape scene that Costner had added without notice. LaBella stated that the crew then brought her in without explanation. She said Costner instructed actor Roger Ivens to simulate rape by pinning her down and lifting her skirt while the set remained open to onlookers.

The incident took place on May 2, 2023, in Utah. One day earlier, LaBella had filmed a scripted rape scene that followed proper procedures. That scene included rehearsals, a closed set, and a licensed intimacy coordinator. LaBella alleged that the following day’s scene lacked all these safeguards.

SAG-AFTRA rules require 48 hours’ notice and performer consent for scenes involving nudity or simulated sex. The rules also mandate the presence of an intimacy coordinator. LaBella said she did not receive notice and felt shocked and traumatized afterward. She reported that crew members later apologized to her and that she spent several days off-set, waiting in costume but not called to film.

Costner denied all claims through his lawyer, Marty Singer. He said LaBella never voiced concerns and even signaled her approval to film the scene by giving a thumbs up to her coordinator. Singer also claimed LaBella had dinner with the stunt team that night and sent a thank-you text.

LaBella’s complaint described the scene as deeply upsetting and said she has not worked with the production team since.
