Harco National Insurance Company is suing Justin Baldoni and his production company, Wayfarer Studios. Baldoni’s insurer has filed a suit in federal court. It claims that they have no obligation to cover the allegations Lively made regarding misconduct on the set of It Ends With Us.
Justin Baldoni’s insurer sues him ahead of deposition
Justin Baldoni and his company, Wayfarer Studios, are getting sued by their own insurer, Harco National Insurance Company. The lawsuit argues it is not obligated to cover claims from Blake Lively’s sexual harassment lawsuit. Filed in the U.S. District Court for the Southern District of New York, Harco’s suit requests a court ruling confirming that its policies do not extend to the allegations brought against Baldoni and his team.
According to Harco, two insurance policies were issued to Wayfarer. One covered July 15, 2023, to July 15, 2024, and the other from July 15, 2024, to July 15, 2025. The insurance company claims that the misconduct alleged by Lively occurred between April and June 2023. They took place before either policy took effect. Harco also emphasizes that Wayfarer failed to report those prior complaints during the application process. This would have excluded such claims from coverage.
Harco’s argument states that Wayfarer submitted a letter as part of its 2023 insurance application. In it, Wayfarer confirmed that neither it nor any insured party was aware of any incidents or circumstances that could lead to an employment-related legal claim. The warranty also stated that any such prior knowledge would void potential coverage.
The complaint read, “Despite this notice, and despite the November 2023 Demand and additional allegations of sexual harassment presented by Lively during a January 2024 meeting, Wayfarer’s 2024 Renewal Application advised Harco that there was no claim, notice of potential claim, or any situation that may give rise to a claim within the last 12 months.” (via The Hollywood Reporter)
The lawsuit names Baldoni, Wayfarer CEO Jamey Heath, co-founder Steve Sarowitz, and the production company behind It Ends With Us as defendants.
